COOKIE INFORMATION
What are cookies
Cookies are small text strings that the sites visited by the user send to his display device, usually to the browser, where they are stored and then retransmitted to the same sites on the next visit by the user himself. During browsing a site, the user may also receive cookies sent by different sites or web servers on his device (so-called “third parties”), on which some elements may reside, such as images, maps, sounds, specific links to pages of other domains, present on the site that the same is visiting.
Cookies, usually present in the browsers of users in large numbers and sometimes even with characteristics of wide temporal persistence, are used for different purposes such as performing computer authentication, monitoring sessions, storing information on specific configurations regarding users accessing the server, etc.
Type of cookie
Cookies are divided into two macro-categories: “technical” cookies and “profiling” cookies.
Technical cookies
Technical cookies are those used for the purpose of “transmitting a communication on an electronic communication network, or to the extent strictly necessary to the provider of an information society service explicitly requested by the subscriber or the user to provide such service” (see art. 122, paragraph 1, of the Code).
They are not used for further purposes and are normally installed directly by the owner or operator of the website. They can be divided into browsing or session cookies, which guarantee the normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); cookies analytics, assimilated to technical cookies where used directly by the site manager to collect information, in aggregate form, on the number of users and how they visit the site itself; functional cookies, which allow the user to navigate according to a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service rendered to the same.
Another type of cookie is the so-called “Flash Cookies” (Local Shared Objects), used within Adobe Flash Player to dispense some content, such as video clips or animations, in order to remember the settings and preferences. Flash cookies are stored on the device, but are managed through a different interface than that provided by the browser used.
The Adobe http://www.adobe.com/devnet/security.html
provides information on how to remove or disable Flash cookies for a specific domain.
For the installation of such cookies, the prior consent of the users is not required, while the obligation to give the information pursuant to art. 13 of the Code, which the site manager, if he uses only such devices, can provide in the manner he considers most suitable.
Profiling cookies
Profiling cookies are aimed at creating profiles related to the user and are used in order to send advertising messages in line with the preferences expressed by the same in the context of online browsing. Due to the particular invasiveness that such devices may have in the private sphere of users, European and Italian regulations provide that the user must be adequately informed about the use of the same and thus express his valid consent.
They are referred to in Article 10 of the Directive. 122 of the Code where it provides that “the storage of information in the terminal equipment of a contractor or a user or access to information already stored is allowed only on condition that the contractor or user has expressed his consent after being informed in the simplified manner referred to in Article 13, paragraph 3” (art. 122, paragraph 1, of the Code).
